CONDITIONS OF TRAVEL

Talofa Cruises; a division of Samoa Shipping Corporation Ltd, (hereinafter called TCSSC) reserves the right to alter any service in any way. Scheduled departures are subject to weather conditions and mechanical failure.

TCSSC accepts no responsibility for loss or damage to luggage, valuables or any other personal items not attributed to the fault or negligence of TCSSC.

Cruise passengers shall comply with the instructions of TCSSC’s employees and agents concerning all matters connected with the service and shall comply with any notice exhibited on vessel or vehicles.

 

DISCHARGE OF LIABILITY

The provisions of the Carriers Act 1975 (‘the Carriers Act’) apply. The Carriers Act limits the TCSSC’s liability for the death of or personal injury to a passenger and/or for loss of or damage to luggage, valuables or incidents which are not attributed to the fault or negligence of TCSSC or its servants or agents acting within the scope of their employment. The Carriers Act limits amounts that may be recoverable by the passenger for any loss or damage to any goods.

BOOKING CONDITIONS

We require a 50% deposit to secure a reservation and our cancellation policy is as follows:

(a)     Cancellation received by TCSSC between 15 and 30 days before departure date of the cruise trip to which the confirmed booking applied: Forfeiture of deposit (50% of relevant cruise fare)

(b)     Cancellation received by TCSSC within 14 days before departure date of the cruise to which the confirmed booking applied: Cancellation fee is equal to 100% of the applicable fare(s).

(c)     All refunds are made at TCSSC’s sole discretion and are not given unless cancellation policy is adhered to first. Any refunded amounts are subject to fees imposed by credit card companies which may be up to 5% of the total transaction.

EQUIPMENT

Reimbursement must be made to TCSSC for any of the company’s equipment lost or damaged whilst in the care of the passengers.

INSURANCE

Passengers are covered under the current insurance policies held by the company whilst onboard our vessels. Passengers may wish to obtain additional insurance at their own discretion.

DECLARATION

TCSSC is hereby discharged by me/us and my/our executors, administrators and dependants from all liability or responsibility for damage and/or injury of any kind whatsoever including death and property damage arising out of or incidental to this cruise trip and such damage and/or injury not due to any negligence on the part of TCSSC.
